Seller Limited Warranty:

 

Seller warrants, to the original purchaser, that its products are free from defects in materials & workmanship for the lifetime of the original purchaser/owner. This warranty does not cover damage resulting from improper handling or shipping of product, improper installation, or damages by, misuse, abuse, fire, flood, acts of God, earthquake, neglect, corrosion, modification or mishandling. In addition, this warranty does not cover cosmetic damage including scratches, dings, dents or cracks that do not affect the structural or functional capability of the product. Coverage terminates if the original purchaser sells or otherwise transfers the product.

 

1. If the installer fails to follow the company’s installation instructions, the Warranty is void. This includes but is not limited to: failure to secure the product(s) into wall studs, substrate failure, failing to properly support the product, top-loading the product, use of unauthorized parts, or installing the product over uneven or unstable surfaces. If you use the product for any unintended use, the Warranty is void.

2. This Limited Warranty is the only Warranty applicable to Artisan Racks products. No oral or written information or advice given by the Company or its Agents or Employees shall create a Warranty or in any way increase the scope of this Limited Warranty.
   
   Coverage;
   During the warranty period, Artisan Racks will repair or replace any product that meets the aforementioned rules. Re-installation is the responsibility of the original Purchaser. This Warranty does not cover any labor costs associated with service, removal, disposal, or re-installation of parts or any incidental costs whatsoever. At the option of Artisan Racks, the original purchase price may be refunded to the original Purchaser for a full refund. Please contact Artisan Racks for further information. Shipping, and handling charges will be at the cost of the original Purchaser.
    

 

 

Dispute Resolutions:

 

You agree that any dispute between you and the Company will be resolved exclusively and finally by arbitration administered by the American Arbitration Association (AAA) and conducted under its rules, except as otherwise provided. The Arbitration will be conducted before a single Arbitrator, and will be limited only between you and the Company. The Arbitration shall be held in San Diego, California by submission of documents, by telephone, by computer-based teleconferencing, or in person. Any decision rendered in such arbitration proceedings will be final and binding on each of the parties, and judgement may be entered thereon in any court of competent jurisdiction. Should either party bring a dispute in a form other than AAA, the Arbitrator may award the other party its reasonable costs and expenses, including attorney fees and disbursements, incurring in staying or dismissing such other proceedings or in otherwise enforcing compliance with this dispute resolution provision.

 

 

Indemnification:

 

You agree to hold harmless any individual of the Company for disputes arising out of your relationship with Artisan Racks. Such individuals include, but are not limited to: ownership, directors, managers, subcontractors or any affiliate of Artisan Racks.

 

You agree to indemnify, defend, release, and hold harmless us, our affiliates, and or respective directors, officers, employees, and agents from any liability, penalty, and expense, including without limitation, reasonable attorney fees, related to your violation of these terms, or your access or use of the website or any of the information or materials available, or products purchased, through our website.

 

Miscellaneous:

 

This agreement shall be governed by the laws of California, without giving effect to conflicts of law rules. In case of inconsistency between the agreement and any other agreement, included with or relating to your product, this agreement shall take precedence. If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement.

 

Artisan Racks, LLC reserves the right to modify or update this document at any time.

 

 

How State Law Relates To The Warranty:

Please consult your state’s laws regarding warranties. You may have rights in addition to the Limited Warranty. Some states do not allow limitations on how long an implied warranty lasts or limitations on incidental or consequential damages. So, the above limitations or exclusions may not apply to you.
